myAudi Privacy Policy

In this Privacy Policy, we are informing you about the processing of your personal data by Audi AG, Auto-Union-Strasse 1, 85057 Ingolstadt ("We") in connection with the myAudi portal.

AUDI AG manufactures vehicles that communicate in certain countries with the AUDI AG IT system or over the Internet with servers of service providers by means of a cellular communication unit (pre-installed or provided by the user). Subject to availability, AUDI AG provides information and control services for your vehicle on the IT system ("Audi Connect Services" or "Services"). Please note that not all Services may be available for your vehicle or in your country.

myAudi enables you to create a user account to use personalised Audi Connect Services as well as other programs and applications of AUDI AG relating to your vehicle. In addition, you can schedule appointments with service partners online or obtain more information on your Audi. Please note that not all features may be available in your country.

These privacy notices describe how AUDI AG processes your personal data within the myAudi portal during the registration process and use of the myAudi portal and in the applications, programs and Services offered therein. Separate privacy notices may apply to the use of Audi Connect Services in the vehicle as well as to other websites beyond the myAudi Portal or other data processing of AUDI AG (e.g. www.audi.com/connect). 1. Who is responsible for data processing and who can I contact?

The Data Controller for the data processing described below within the meaning of Article 4(7) GDPR is AUDI AG, Auto-Union-Strasse 1, 85045 Ingolstadt. For individual data processing operations, AUDI AG is joint controller with the Operator of a myAudi shop (see list of importers in Annex A, hereinafter referred to as the Shop Operators) or is joint controller with Volkswagen Payments S.A. (hereinafter referred to as EMI) as payment service provider. Whether AUDI AG is the sole Data Controller for data processing or is the joint Data Controller for data processing with the Shop Operator or EMI is set out in Section 2 below. 2. General Information

2.1 Which data do We process and which sources does it come from?

We process your personal data in accordance with the provisions of the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG) for various purposes. The specific purposes of data processing are primarily based on the functionalities and Services you use.

2.2 Data processing for which AUDI AG is the sole Data Controller

2.2.1 Access to the Website

In principle, you can access the website www.myaudi.de ("Website") without providing any personal data. However, the use of certain Services requires registration on the portal and the provision of personal data. In addition, We process your personal data if you contact us via the Website. Information on the processing of personal data in connection with your "myAudi" account can be found in the section "Special Information – myAudi."

Each time you use the Website, your Internet browser automatically transmits certain information and stores it in so-called log files.

In particular, the following information is transmitted automatically:

• IP address (Internet Protocol address) of the terminal from which the online offering is accessed;
• Internet address of the website from which the online offering was retrieved (so-called origin or referrer URL);
• Name of the service provider via which the online offering is accessed;
• name of the files or information retrieved;
• date, time, and duration of retrieval;
• volume of data transmitted;
• Operating system and information on the Internet browser used, including installed add-ons (e.g. for the Flash Player);
• http status code (e.g. "request successful" or "requested file not found").

In the log files, the above data is stored without your complete IP address, so that no attribution to your IP address is possible.

2.2.2 Data provided by you

In order to access certain Services and functionalities in the myAudi portal, you need to register and log in with your email address and, if necessary, provide further information and data, e.g. contact details. We process the data that you provide during your registration or in the portal or when using the functionalities and Services. Further information on the processing of your personal data in connection with the individual features can be found starting in section 3.

2.2.3 User tracking and use-based online advertising

This website uses Adobe Analytics, Adobe Systems Software Ireland Limited, 4-6 Riverwalk, Citywest Business Campus, Dublin 24, Republic of Ireland (including Omniture Site Catalyst, Omniture Genesis, Omniture Discover, Omniture TagManager, Omniture SaintBernard), a web analysis tool, which allows us to optimize our services to your needs so that the our websites are always up-to-date, focused on users and fully functional. Adobe Analytics uses cookies that can track your preferences when you visit our sites. These are used, for example, to make navigation easier – and so that we can make our services even more user-friendly. The data is processed for the purposes of advertising, market research and to design our website to meet demand (according to Section 15 para. 3 of the German Telemedia Act (TMG)). The information (including your IP address) generated therein is anonymised by default before being saved, thus preventing any personal reference to you. This website has also been designed to ensure that IP addresses are only recorded in anonymised format (known as IP masking). The information stored on the Adobe servers cannot be used to identify an individual directly, because Adobe Analytics is used with the following settings: "Before Geo-Lookup: Replace visitor’s last IP octet with 0" and "Obfuscate IP-Removed". The setting "Before Geo-Lookup: Replace visitor’s last IP octet with 0" ensures that the IP address is anonymised before geo-lookup by replacing the last octet of the IP address with zeros. The approximate location of the user is used to statistically evaluate the tracking packet, which still contains the full IP address. Before the tracking packet is stored, the IP address is then replaced by a single fixed IP address - which is a generic IP address - if the "Obfuscate IP–removed" setting is configured. This means that the IP address is no longer included in a stored record.
Data is to be evaluated for reporting only after it has been anonymised. The information generated by these cookies is normally transmitted to an Adobe server within the European Union. However, it is not possible to rule out that, in the event of a technical emergency, this data will be transmitted to the United States and stored there, so an applicable standard EU agreement (suitable guarantee for data processing in non-European countries) has been signed. You have the right to be informed of the content of this standard agreement.
As a user of our website, you can refuse to accept cookies via your browser settings at any time. By default, most browsers allow cookies to be stored. Changing this setting may limit the features of our websites. You may object to the data generated by the cookie and relating to your use of the website from being collected by Adobe - with effect for the future - and object to the data being processed by Adobe at any time by setting a specific opt-out cookie. 2.1.4 Further Data

We process data that you provide to your Audi partner when it performs the myAudi registration on your behalf. In this regard, you must only enter the data required for the registration or primary user verification as well as any other functionalities you may use. Please refer to section 3 et seqq. for the required data.

We also process data from your vehicle for certain Services. Details of the relevant Services can be found in the Special Information starting in section 3.

Information about data processing related to the use of cookies and user tracking as well as data processing related to specific functionalities can be found in the relevant sections.

2.2 For what purposes do We process your data and on which legal ground?

2.3 Is there an obligation for me to provide data?

As part of our business relationship, you only need to provide the personal data that is required to enter into and conduct a business relationship, or that We are required to collect by law. Without this data, We will generally have to refuse to enter into the agreement or to execute the order, or will be unable to carry out an existing agreement and possibly have to terminate it. This means that the use of a Service or a functionality requires that you provide the specified data. Unless you provide the data, We cannot provide the Service to you.

2.4 Who receives my data?

Within Audi AG, those entities receive your data that they need to fulfil our contractual and statutory obligations and to safeguard our legitimate interests.
Our service providers (so-called contract processors) that We utilise and engage may also receive data for these purposes.

We will generally share your personal data with third parties only if this is necessary for the fulfilment of the contract, if We or the third party have a legitimate interest in the disclosure, or if you have granted your consent.

In addition, data may be shared with third parties (including investigative or security authorities) to the extent We should be required to do so by law or by enforceable regulatory or judicial orders.

Details of the contract processors We use and the other recipients who receive personal data are included in section 3 et seqq. Due to the size and complexity of data processing by Audi AG, it is not possible to list each recipient of your personal data individually in this Privacy Policy, which is why only categories of recipients are specified as a rule.

2.4.1 Contract Processors

We utilise contract processors of the following categories for the provision of specific services, who support us in the execution of our business processes. Specifically, this includes undertakings in the following categories:

• Tracking service providers (see cookies and user tracking)
• Web agencies
• Hosting providers

2.4.2 Third parties

• Log files are shared with investigating authorities on a case-by-case basis.

If We share your data with additional contract processors or third parties within the framework of individual features, We will inform you in the feature starting in section 3.

2.5 Is data transmitted to a third country?

A transfer of data to third countries (i.e. countries that are neither members of the European Union nor of the European Economic Area) may take place, to the extent this is required for the provision of Services to you, is required by law, or you have given us your consent. In addition, We may also share your personal data with contract processors in third countries.

Please note that not all third countries have a level of data protection recognised as adequate by the European Commission. For data transfers to third countries where there is no adequate level of data protection, We ensure that, prior to disclosure, the recipient has either an adequate level of data protection (e.g. by a self-certification of the recipient for the EU-US Privacy Shield or the agreement of so-called EU standard contractual clauses of the European Union with the recipient), or We have obtained express consent from our users.

You can obtain a copy from us of the specific applicable or agreed rules to ensure the adequate level of data protection. Please use the information in the Contact section for this purpose.

2.6 How long will my data be stored?

We store your data as long as it is necessary for the provision of our services to you or We have a legitimate interest in the further storage, in particular for reasons of troubleshooting.

The log files with personal data are saved by us for the investigation of malfunctions and for security reasons (e.g. for investigating attack attempts) for 7 days, and then deleted. Log files whose further retention is required for evidentiary purposes are exempt from deletion until the final clarification of the respective incident.

In addition, We are subject to various retention and documentation obligations, which result, inter alia, from the German Commercial Code (HGB) and the German Tax Code (AO). The periods specified therefore for retention and documentation are up to ten years. Finally, the storage period is also assessed according to the statutory limitation periods, which can be up to thirty years, for example, according to Sections 195 et seqq. of the German Civil Code (Bürgerliches Gesetzbuch, BGB), with the regular period of limitation being three years.

Under certain circumstances, your data may also need to be retained for a longer period of time, such as when a so-called legal hold or litigation hold (i.e. a prohibition of data deletion for the duration of the proceedings) is ordered in connection with administrative or judicial proceedings.

To the extent further details are possible, you will find further information on retention obligations in section 3 et seqq.

2.7 Do I have a special right to object?

In connection with user tracking, you can technically implement your right of objection. See the "User Tracking" section.

2.8 Which rights do I have?

As the data subject, you are generally entitled to the following data protection rights:

Information

You have the right to request information on the data stored concerning you at Audi AG and the scope of data processing and data transfer performed by Audi AG, and to obtain a copy of the personal data stored concerning you.

Rectification

You have the right to obtain without undue delay the rectification of inaccurate personal data concerning you as well as the completion of incomplete personal data stored concerning you at Audi AG.

Erasure

You have the right to obtain the erasure of the personal data concerning you stored at Audi AG without undue delay if the statutory requirements are met.

This may be the case, in particular, if
• Your personal data are no longer necessary in relation to the purposes for which they were collected;
• The sole legal ground for the processing was your consent and you have withdrawn it;
• You have objected to the processing based on the legal ground of a balancing of interests on grounds relating to your particular situation and We cannot prove that there are overriding legitimate grounds for the processing;
• Your personal data have been unlawfully processed; or
• Your personal data have to be erased for compliance with a legal obligation.

If We have shared your data with third parties, We will inform them about the erasure, insofar as required by law.

Please note that your right to erasure is subject to restrictions. For example, We are no required or allowed to delete data that We are still obligated to retain due to statutory retention periods. Similarly, data that We need for the establishment, exercise or defence of legal claims are excluded from your right of erasure.

Restriction of processing

You have the right to obtain, under certain conditions, restriction of processing (i.e. the marking of stored personal data in order to restrict their future processing). The conditions are:

• The accuracy of your personal data is contested and Audi AG must verify the accuracy of your personal data;
• The processing is unlawful, but you oppose the erasure of the personal data and instead request the restriction of the use of the personal data;
• Audi AG no longer needs your personal data for the purposes of processing, but you require the data for the establishment, exercise or defence of legal claims.
• You have objected to the processing and the verification is pending whether the legitimate grounds of Audi AG override yours.

In the event of a restriction of the processing, such data will be marked accordingly and will be – except for their storage – only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.

Data portability

To the extent that We automatically process your personal data provided to us based on your consent or a contract with you (including your employment contract), you have the right to receive the data in a structured, commonly used and machine-readable format and to transmit those data to another controller without hindrance from Audi AG. You also have the right to have the personal data transmitted directly from Audi AG to another controller where technically feasible and provided that this does not adversely affect the rights and freedoms of others.

Objection

If We process your personal data on the basis of legitimate interests or in the public interest, you have the right to object to the processing of your personal data on grounds relating to your particular situation. In addition, you have an unrestricted right to object if We process your data for our direct marketing purposes. Please see our separate note in the "Information on your right to object" section.
In certain cases, We also grant you, beyond the privacy settings, an additional unlimited right to object within the scope of the balancing of interests. We will inform you about this in the "Special Information – Service" section.

Withdrawal of consent

If you have given consent to the processing of your personal data, you may withdraw it at any time. Please note that the withdrawal shall only be effective for the future. Processing that occurred before the withdrawal shall not be affected.

Complaint

In addition, you have the right to lodge a complaint with a data protection supervisory authority if you believe that the processing of your personal data is unlawful. 2.9 Information on your right to object

Right to object on grounds relating to your particular situation

You have the right to object to the processing of your personal data on grounds relating to your particular situation. The prerequisite for this is that the data processing takes place in the public interest or on the basis of a balancing of interests. This also applies for any profiling.

Insofar as We base the processing of your personal data on a balancing of interests, We generally assume that compelling legitimate grounds can be demonstrated, but We will, of course, examine each individual case.

In the event of an objection, We will no longer process your personal data. Unless

• We can demonstrate compelling legitimate grounds for the processing of such data which override your interests, rights and freedoms or
• Your personal data are used for the establishment, exercise or defence of legal claims.

Objection to the processing of your data for our direct marketing purposes

Where We process your personal data for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing; this also applies to profiling to the extent that it is related to such direct marketing.

If you object to the processing for direct marketing purposes, We will no longer process your personal data for such purposes.

3. Special Information – myAudi registration, profile management, primary user verification, user setup, vehicle setup, my Audi partner

Within the framework of the registration, profile management and user setup in the portal, We process the following data or categories of data which you specify when setting up your profile or using the functionalities. We process the data for the fulfilment of a contract with you or for the implementation of pre-contractual measures or (if indicated) on the basis of your consent.
No data is shared with contract processors or third parties outside the European Union or the European Economic Area.

This data includes:

Registration, profile management

Name, personal or professional contact details (email, address, telephone number), date of birth during the registration and profile setup to create your myAudi account. In order to access the portal, you only need to provide the personal data that is required for registration or that We are required to collect by law. This includes the name, salutation and username (your email address) for the portal. Without this data, We will have to refuse access to the portal, or will be unable to carry out an existing agreement and possibly have to terminate it. All other information is voluntary and is not required to access the portal, but only stored for the future use of additional features. You can also enter the data later if this is necessary for a feature. To the extent the additional data is necessary for the use of individual functionalities in the portal, We will inform you of this in connection with the respective functionality.

In order to optimise our sales activities to the needs of our customers and to structure them in a user-oriented manner, as well as to improve our Services and support our customers, We process your vehicle identification number, registration date and usage data in order to protect our legitimate interests in improving our sales structure. We do not create a profile, but merely process whether you have registered with myAudi and whether you are using our Audi Connect Services.

Primary user verification

Name, personal or professional contact details (email, address, telephone number), date of birth during the verification of the primary user and the conclusion of the primary user contract. Provided that you select a landline or mobile phone for verification of the primary user, Audi AG may, in compliance with statutory requirements, use an automated call machine to call the telephone number provided for the purpose of verifying your identity or send you pre-recorded messages or text messages, as appropriate. We will send you an email if you chose the verification by email. Provided you select an Audi partner for verification, We will transmit your data to the Audi partner you have selected for the performance of the verification.

Audi connect user management

Name, personal or professional contact details (email, address, telephone number), date of birth during the setup of another user for a vehicle.

Vehicle management/vehicle details

Vehicle identification number for adding a vehicle to your myAudi account. This is required in order to use certain applications and Connect Services in your vehicle or to use the vehicle management in the myAudi portal. You can add a vehicle to your myAudi Account by entering and saving your vehicle identification number. By entering your vehicle identification number or your commission number and your myAudi Account activation code in the vehicle management, your vehicle's equipment details are linked to your myAudi account and saved.

Newsletter sign up

This Website also offers the possibility to subscribe to a newsletter. We process the data provided by you in connection with the newsletter registration (email address, surname, first name and salutation) for the purpose of sending the newsletter within the scope of your given consent (Article 6 (1) (1) (a) GDPR). For the activation of the newsletter, We use the so-called double opt-in procedure, i.e. We will send you an email to the specified email address with a request for confirmation of your consent. You may withdraw your consent at any time without stating reasons to AUDI AG with effect for the future, e.g. via the "unsubscribe" link included in each newsletter or through our customer service. If you unsubscribe from the newsletter, your personal data will be deleted, unless We process your data on the basis of another legal ground or if there are retention obligations. A contract data processor is utilised for sending the newsletter.

Product information and market research

If you would like to receive information on our products and services, you can subscribe to this advertising. For this purpose, the following data will be processed for the purpose of advertising delivery within the scope of your given consent (Article 6 (1) (1) (a) GDPR): surname, first name, email address and/or telephone number). If you agree to the contact by email, We use the so-called double-opt-in procedure, i.e. We will send you an email to the specified email address with a request for confirmation of your consent. Regarding how to withdraw your consent, see the section entitled "What rights do I have?"

4. Special Information – myAudi functionalities

We also process the following data or categories of data as part of the Services provided in myAudi. We process the data for the fulfilment of a contract with you or for the implementation of pre-contractual measures or (if indicated) on the basis of your consent.
No data is shared with contract processors or third parties outside the European Union or the European Economic Area.

Pickup day and online daily planning

The myAudi pickup day application allows you to schedule an appointment to pick up your new car and to book and plan additional services/activities. For this purpose, We store the data provided by you when booking, i.e. your contact details (email, telephone) and the desired pickup date and location as well as the vehicle identification number in order to carry out the desired booking of the appointment and to contact you regarding the desired scheduling. You can also specify additional data for the daily planning and booking of additional services: arrival time, method of arrival, arrival vehicle (make, year of construction), number of accompanying persons, request for factory/museum tour and assistance system training. You can save the data in your myAudi account after booking and view it up to 21 days after your pickup date. In addition, We process the vehicle details stored with us regarding the vehicle, i.e. technical equipment, in order to display them to you in your myAudi account. We will also process your email address to send you the daily schedule and pickup date to the email address you specify, if you have explicitly selected this.

Calendar

The calendar offers you the opportunity to save various appointments relating to your vehicle in myAudi. We process the data that you actively save in your calendar until you delete it yourself.

Audi online consultation

You can access the Audi online consultation of AUDI AG via the Website, which provides you with live advice via video, text chat and voice calls. Further information on the handling of your data by AUDI AG can be found in the feature or on www.audi.de.

Saved configurations

You can save vehicle configurations in your myAudi account. We process the following data or data categories for this purpose: vehicle configuration.

Comment/feedback feature

The comment/feedback feature allows you to send us comments and suggestions via a comment field. To this end, you will be forwarded to our website www.audi.de. We process the data provided by you in the comment field as well as your specified contact details in order to process your request. Further information on the handling of your data by AUDI AG can be found at www.audi.de.

Service appointment request/booking

As part of the service appointment request/booking, you can request and book service appointments with your selected Audi service partner. When submitting your request and/or booking, We process the following data or data categories that you have specified when making the request/booking: Service appointment booking: name, contact details (address, email address, mobile number), license plate number, approximate mileage) and the vehicle identification number of your Audi.

We process the data for the execution of the concrete request/booking as well as for further use for you in your myAudi account for future requests and/or bookings. We transmit the data to your selected Audi service partner for scheduling and execution of the appointment. You can enter an appointment confirmation from your Audi service partner in your personal myAudi calendar.
You can delete or change the data in your myAudi account at any time. We store the data until you delete or change it.

Digital service plan

This feature allows you to view and retrieve the service plan for your vehicle in myAudi. We process the following data or data categories for this purpose: vehicle identification number of your vehicle, information on service measures carried out. You can view and retrieve this data in your myAudi account. We save this data to your myAudi account until you delete it in your myAudi account or unlink the assignment to the vehicle. Please note that We do not delete the data completely, but the assignment to your myAudi account is merely cancelled. The data is still stored together with the associated vehicle identification number.

Cost book/logbook

This feature allows you to keep a manual cost or log book. We process the data provided by you in the cost/logbook for this purpose. These include:
Logbook: category (type), mileage, date, start and destination address (street, town, country);
Cost book: category (type), date, amount, for refueling entry: refueled amount.
You can view and retrieve this data in your myAudi account. We save this data until you delete it in your myAudi account or unlink the assignment to the vehicle.

Field measures

Via a query based on the vehicle identification number you enter, you can call up field measures and recall campaigns for the vehicle. The data you enter will not be saved.

Used vehicle exchange search

fter entering search criteria, you can save the search for a used vehicle on the Audi used vehicle exchange in your myAudi account and enter your email address for notifications. If an appropriate vehicle is placed on the used vehicle exchange by an Audi partner, you will receive an email to the email address you have provided. You can manage your search requests yourself and delete them at any time. We save your search request until you delete it yourself.

My Audi partner

You can save a favourite Audi partner in your myAudi account. The latter receives access to the profile data you have stored, to the extent this is necessary in order to carry out the primary user verification or to activate features for you.

Data packages

If you want to book data packages for your vehicle, you can be forwarded via this Website to the website of the provider Cubic Telecom. If you consent, We will share your personal data with Cubic Telecom (for Wi-Fi data packages), so that you do not need to re-enter your information when making your booking.

5. Special Information – cookies

The Website uses so-called "cookies." Cookies are small files that are stored on the user's computer when visiting a website. Cookies can store various types of data and help to provide additional functionality (thus making the website more user-friendly, effective and secure overall). If cookies are used, they contain pseudonymised data, unless you have given your express consent to the processing of your personal data. To this end, this Website has been adapted to ensure the anonymised collection of IP addresses (so-called IP masking). 7. Special Information – Audi connect Services

7.1 General Information

The use of personalised Audi connect Services requires registration in the myAudi portal. In order to provide personalised services in your vehicle, AUDI AG transfers your myAudi Account data (myAudi user name and password token) to your vehicle.
The Services available for your vehicle and license durations are assigned and saved to your myAudi Account.
The data you enter into the myAudi Portal are saved and made available to your vehicle (which you previously added to your myAudi Account) on demand. You can specify a preferred notification channel (e.g. email address) for application notification features, e.g. information on your vehicle’s climate and charge status (in the case of Audi e-tron vehicles).
Your vehicle also transfers certain data to the Audi back end for some Services (as described in the Service below) so that you can view and retrieve it in your myAudi account.

7.2 Remote auxiliary heater (remote Service)

The Audi connect Service remote auxiliary heater is a personalised Service, i.e. the prerequisite for the use of the Service is the registration and opening of a separate and individual myAudi account. In your myAudi account, you can configure the Service, a schedule for your auxiliary heater, and transmit certain data and content for the features of your Audi connect Services (via your mobile phone connection) to your vehicle and allow certain vehicle data to be transferred to us from the vehicle (as described below).

As part of the Service, We process the following data or categories of data from your vehicle: the vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner), the planned departure timer you have entered, the heating effect (defrost or interior heating), availability of auxiliary heating functionality (status tank empty, battery empty, system error), current status of the climate control system (heating, ventilation, not active).This data is sent by your vehicle to the AUDI AG IT systems with the timestamp when you modify a timer, the climate control status (start, end of a climate control process) and/or the availability of the auxiliary heating functionality.

We process the above data to provide the Service to enable you to remotely control your auxiliary heater via the app.

We save the settings of your timers until you change them yourself or unlink the assignment of the vehicle to your myAudi account. The climate control information from your vehicle is deleted each time a new record is sent, so that We only store the current record. The last 10 actions are stored there to fulfil our contractual obligations and to safeguard our legitimate interests in ensuring system security (Article 6 (1) (1) (f) GDPR).

7.3 Remote locking and unlocking (remote Service)

This Service allows you to lock and unlock your vehicle via your mobile device. As part of the Service, We process the following data or categories of data from your vehicle: vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner), executed action (lock/unlock), condition of the vehicle doors and hatches and timestamp and ID of the mobile device used.

The corresponding data will be sent directly to AUDI AG upon execution of the Service and will then be available for retrieval using your smartphone via the myAudi app and via myAudi. The Service can be deactivated by the primary user in the myAudi portal.

We process the above data to provide the Service to enable you to remotely lock and unlock your vehicle via the app.

We log the use of the Service and store the actions for the purposes of system security and theft prevention and tracking for the fulfilment of the contract and the safeguarding of our legitimate interests in securing the Service for up to 5 years.

7.4 Remote horn and flashing

This Service enables you to trigger the vehicle's horn and signals via your mobile device. As part of the Service, We process the following data or categories of data from your vehicle: vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner), executed action and timestamp and ID of the mobile device used, current position of your vehicle (location data) and position of your mobile device.

We process the above data to provide the Service to enable you to remotely control your vehicle's horn and flashing within a certain radius of your vehicle via the app. For the perimeter detection, the position of the vehicle and the terminal are required.

The position data of your mobile device will be deleted after the action has been performed. We store the data of the last 10 actions (action and time) for the fulfilment of the contract and the safeguarding of our legitimate interests in the security of our systems (Article 6 (1) (1) (f) GDPR) until you unlink the assignment of the vehicle to your myAudi account. The oldest data are deleted each time a new record is sent.

7.5 Privacy settings

You have the option of making certain privacy settings in your vehicle menu and deactivating the transmission of different data categories or deactivating individual Services. Your current setting can be accessed by authorised users of the vehicle in the myAudi account or via the app.

As part of the Service, We process the following data or categories of data from your vehicle: vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner), the chosen privacy setting.

We process the above data to enable you and authorised users to view the privacy settings in the myAudi web portal or in the Audi smartphone app.

7.6 Special Information – Audi connect key

The Audi Connect Service Audi connect key is a personalised and safety-relevant Service. It allows the user to unlock, start and lock the vehicle. Prerequisite for the use of the Service is the previous registration in the myAudi portal or the creation of a myAudi account and the verification as the primary user. Furthermore, the use of the Audi connect key requires the download of the MMI connect app.

For the proper assignment of the Audi connect key to a user's mobile device, this device transmits the following personal data to the IT systems of AUDI AG for the purposes of authentication and authorisation: IMEI, ICCID, device type, app version and OS version. This data is stored in the IT systems of AUDI AG together with the vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner) and the assigned key for the purpose of authentication and verification of authorisation until the assignment of the terminal device is unlinked. This is required for the device to be recognised as an authorised key.

When assigning a key to a user, you can allow the app to access the address book and select users there.

With the assignment of an Audi connect key to a user, the respective vehicle is also linked to the user and the user can see the vehicle and the vehicle equipment in his or her myAudi account. The primary user can see which users (email address) with which key name (which the primary user himself or herself has assigned) are assigned to the vehicle.

When using the Audi connect key, i.e. when unlocking, starting and locking the vehicle using the mobile terminal, data is transmitted from the mobile terminal to the vehicle by means of Near Field Communication (NFC). This data is not transmitted to AUDI AG.

In addition, when using the Audi connect key, the following data are transmitted to the AUDI AG IT systems and logged and stored for the purpose of monitoring and ensuring the security of the Service for the fulfilment of the contract: ICCID of the mobile terminal, vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner), key status and authorisation status, type of use (e.g. unlock vehicle) and time of use in case of changes.

7.7 Special Information – online traffic information

MIB2+

Online traffic information informs you about current traffic events and shows the traffic flow in the map and along the route of your MMI system or myAudi app. To this end, your vehicle sends the following data to the IT systems of AUDI AG: current position of your vehicle (use in the vehicle) or the current map section to be displayed (use in the myAudi App), the desired destination, and settings in your vehicle for traffic information. The data transmission follows the principle of data economy. For this purpose, all requests from your vehicle are pseudonymised. The check of the use authorisation is pseudonymised. The data is transmitted to the service provider with a different pseudonym for each drive cycle (session ID). The service provider does not receive either your name or your vehicle identification number. In addition to the aforementioned Service-specific data, the metadata required to provide the Service is transferred: timestamp, information on SW versions used, map or map tile versions used. The above data is sent to the service provider for delivery: HERE Global B.V., Kennedyplein 222-226, 5611 ZT Eindhoven, Netherlands. The service provider for providing the traffic information is TomTom Germany GmbH & Co. KG, Am Neuen Horizont 1, 31177 Harsum, Germany. Throughout a drive cycle, this service provider continuously receives the position data as well as information from vehicle sensors on vehicle speed, direction of travel and metadata about the quality of the sensor data. This data is continuously transmitted from your vehicle to the IT systems of Audi AG. It is not stored there, but forwarded directly to the service provider. The data transmission follows the principle of data economy. For this purpose, all requests from your vehicle are pseudonymised. The check of the use authorisation is pseudonymised. The data is transmitted to the service provider with a different pseudonym for each drive cycle (session ID). The service provider does not receive either your name or your vehicle identification number.

MIB2, MIB1, MMI3G+

Online traffic information informs you about current traffic events and shows the traffic flow in the map and along the route of your MMI system or myAudi app. To this end, your vehicle sends the following data to the IT systems of AUDI AG: current position of your vehicle (use in the vehicle) or the current map section to be displayed (use in the myAudi App), the desired destination, and settings for traffic information. These data are transmitted to the service provider for delivery when using the myAudi app: HERE Global B.V., Kennedyplein 222-226, 5611 ZT Eindhoven, Netherlands. When used in your vehicle, the data is transmitted to the service provider for the provision of traffic information: TomTom Germany GmbH & Co KG, Am Neuen Horizont 1, 31177 Harsum, Germany. Throughout a drive cycle, this service provider continuously receives the current vehicle position (GPS data), the numbers of roads driven, as well as information from vehicle sensors on vehicle speed, direction of travel and metadata about the quality of the sensor data for the purposes of the Service provision, Service optimisation and Service development. This data is sent continuously to the service provider using a pseudonym (session ID). In each drive cycle, a new pseudonym is assigned. The service provider does not receive either your name or your vehicle identification number.

7.8 Special Information – destination feed via myAudi or Google Maps™ and Picturebook Navigation

MIB2, MIB1, MMI3G+

With this Service, you can use your myAudi account and the mobile connection you use to transfer data stored in your myAudi account (e.g. navigation destinations stored in the myAudi account, settings, etc.) for the features of the Service to your vehicle via GoogleMaps™.

For this Service, We process your myAudi user ID for the assignment of your myAudi account. We provide the data in your myAudi account and store the data until you delete it in your myAudi account.

7.9 Special Information – vehicle status report

The vehicle status report Service allows you to view the various vehicle data via myAudi or your mobile device. As part of the Service, We process the following data or categories of data from your vehicle: the vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner) as well as the current status of the doors (locking status) and status of windows, hatches and, if applicable, convertible/sunroof, spoiler status, fuel and oil level, mileage, total range, parking light status, current warning messages, parking brake status, tire pressure, data transmission time, as well as ambient data (outside temperature) and battery charge status for e-tron vehicles.

The corresponding data are sent directly to our IT systems via the app upon turning on or turning off the vehicle, locking and unlocking, when opening or closing doors as well as upon reaching the critical state of charge of the 12V battery or on your request by access in myAudi or on your mobile device, and is subsequently available for retrieval via the app and via myAudi. In addition, your vehicle sends the position of your vehicle when the vehicle is turned off. The vehicle status is visible to every authorised myAudi user who has been activated by the primary user for this vehicle.

We process the above data for the provision of the Service in order to provide you and the authorised myAudi users with the information in myAudi for retrieval. Only the last record sent by the vehicle is stored so that it can be displayed to you, and this is overwritten when a new record is sent.

7.10 Last parking position

The last parking position Service allows you to call up the last known location of your vehicle after parking and locking. The address and navigation to the location can be displayed in the app.

As part of the Service, We process the following data or categories of data from your vehicle: last known position of the vehicle when locking the vehicle together with the vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner). It is not possible to call up the position while driving. In the case of Audi A3 Sportback e-tron vehicles, the last parking position is visible to every authorised myAudi user who has been activated by the primary user for this vehicle. The Service can be deactivated for the respective vehicle in the myAudi portal.

The last position is stored until the vehicle sends a new position as part of the Service. No motion profiles of your vehicle are created. The Service can be deactivated by the primary user in the myAudi portal.

7.11 Special Information – map display in the app

In order to be able to display a current navigation map in the app, information on the map section to be displayed is transmitted to our service provider. The data transmission follows the principle of data economy. For this purpose, all requests from your vehicle are pseudonymised. The check of the use authorisation is pseudonymised. The data is transmitted to the service provider with a different pseudonym for each drive cycle (session ID). The service provider does not receive either your name or your vehicle identification number. In addition to the aforementioned Service-specific data, the metadata required to provide the Service is transferred: timestamp, information on SW versions used, map or map tile versions used. The Service is provided by the following service provider: HERE Global B.V., Kennedyplein 222-226, 5611 ZT Eindhoven, Netherlands.

7.12 Special Information – anti-theft alarm system

If your vehicle detects a possible theft event, you can be informed via a communication channel of your choice. As part of the Service, We process the following data or categories of data from your vehicle: vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner), detected event (triggering event) and timestamp.

In your myAudi account, you can specify a preferred communication channel that informs you about an event. An alarm history is displayed to you in your myAudi account and saved to your myAudi account.

We process the above data for the provision of the Service to provide you with alerts about a possible theft as a primary or authorised user via the selected communication channel. You can view and delete an alarm history via your myAudi account. We save the data in connection with your myAudi account until you delete it or unlink the assignment of the vehicle to your myAudi account.

7.13 Special Information – theft and tracking assistant

The Audi Connect Service anti-theft system is a personalised Service, i.e. the prerequisite for the use of the Service is the registration and opening of a separate and individual myAudi account. In your myAudi account, the primary user can configure the Service and activate or deactivate it.

To activate the Service, We process the following data that you provide when you activate the Service in your myAudi account: Registration: name and contact details (address, up to 3 mobile numbers) as well as information on the vehicle (colour, body type, license plate), vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner). This data is transmitted to our service provider Vodafone Automotive Telematics SA, Via S. Franscini 10, 6850 Mendrisio, Switzerland or to a local service provider commissioned by the service provider to create the registration and activation.

If the vehicle detects tampering, the vehicle sends the following data or categories of data to us and the service provider: tampering event, current vehicle position (location data, time and place), vehicle condition data (mileage, battery voltage, speed, fuelling level, time out of vehicle, ignition status, engine status). The vehicle then cyclically sends the current vehicle position.

These data are transmitted to our service provider. The service provider then contacts the contact information stored by the primary user in order to forward the alarm.

With the consent of the primary user and upon confirmation of a theft or notification of a theft by the primary user, the service provider transmits the last known vehicle position to the national security or investigation authorities.

If the primary user reports a theft, the above data can also be actively queried from the vehicle via the service provider.

We process the above data to provide the Service to detect tampering events and to enable the localisation of your vehicle in case of theft.

This Service can only be activated or deactivated by the primary user. It will not turn off when privacy settings are activated.

7.14 Special Information – CarFinder

As part of the Service, We process the following data or categories of data from your vehicle: last known position of the vehicle when parking the vehicle together with the vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner).

The corresponding data will be sent directly to AUDI AG when turning off the vehicle and will then be available for retrieval using your smartphone via the myAudi app and via myAudi. The last position is stored until the vehicle sends a new position as part of the Service. No motion profiles of your vehicle are created. The Service can be deactivated by the primary user in the myAudi portal.

We process the above data to provide the Service in order to show you the current parking position of your vehicle in myAudi.

7.15 Special Information – online traffic light info

As part of the Service, We process the following data or categories of data from your vehicle: vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner), current vehicle position (location data, location and time) when approaching a traffic light and when traversing the traffic light together with the detected traffic light status.

We process the above data to provide the Service in order to display the remaining duration of the red phase at a red light on your route and recommendations for an optimal speed to utilise the green phases. We also process the data for purposes of quality assurance and verification of the accuracy of the detection, and store the data for a period of 1 week to safeguard our legitimate interests (Article 6 (1) (1) (f) GDPR).

7.16 Special Information – speed alert

With this Service, you can save a speed limit and a timer in your myAudi account. These data are subsequently available for retrieval via your vehicle navigation unit.

As part of the Service, We process the following data or categories of data from your vehicle: vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner), information if the speed limits stored in the myAudi account are exceeded within the defined times.

Your vehicle informs you via your selected information channel when the vehicle exceeds the defined speed.

We process the above data to provide the Service in order to inform you of the defined speed exceedances.

We save the data until you delete it from your myAudi account or delete your myAudi account itself.

7.17 Special Information – valet alarm

As part of the Service, We process the following data or categories of data from your vehicle: vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner), event when the stored speed limit is exceeded within the defined times, event when the defined geo range is exceeded.

We process the above data to provide the Service in order to inform you of the defined area exceedances.

We save the data until you delete it from your myAudi account or delete your myAudi account itself.

7.18 Special Information – geofence

7.19 Map update

This service can be used to update the navigation database online directly in the vehicle. For this service, the vehicle analyses the areas within a region (e.g. Bavaria) that are relevant for the vehicle and sends that information to the Audi IT systems. If the customer consents, the map update is then provided and is downloaded in the vehicle from the Audi IT systems. Once the update has been delivered, all of this information is deleted from our IT systems again. We may use a service provider (HERE Global B.V., Kenedyplein 222, 5611 ZT Eindhoven, Netherlands) to provide the maps. This service provider does not receive any data relating to the vehicle or any personal data.

8. Special Information – connect e-tron Services

The following online Services are available to you in Audi e-tron vehicles. Again, please note that not all listed Services may be available in your vehicle or country.

For Audi A3 Sportback e-tron vehicles, entering the mileage in the myAudi portal is necessary to activate the following Services. In addition, the vehicle always transmits the mileage to AUDI AG during the ignition process.

8.1 Special information – trip data

As part of the Service, We process the following data or categories of data from your vehicle: distance travelled, route length, consumption (fuel consumption, electrical consumption, secondary consumption, e.g. oil), total mileage at the beginning and end of the trip, average speed, trip time, time of the transmission of data. Depending on your model or the equipment of your vehicle, not all of the data listed may be transmitted from your vehicle.

After completing a trip, the data is transferred to myAudi or the MMI connect App for display. The transmitted data can be retrieved at any time via myAudi or using a smartphone.

We process the above data to provide the Service in order to show you the information on your recent trips in myAudi or on a smartphone. The data are available until deletion by you. You can delete the data in myAudi or using a smartphone.

8.2 Special Information – remote operation and display charging/charging equipment status

As part of the Service, We process the following data or categories of data from your vehicle: vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner), information and status of the charging process (e.g. charging duration, charge state), properties of the charging process (e.g. current, amount of energy, charging power), selected departure time, remaining charging duration, user's own power requirement, drive type, range. Depending on your vehicle, We may not process all of the data listed above.

We also process the charging timers and departure times you have planned in myAudi.

We process the above data to provide the Service, to display the information on your charging process in myAudi, and to program and control the charging process via myAudi and to optimise the charge process according to your wishes stored in myAudi and MMI.

We save your charge settings until you change them or unlink the assignment of the vehicle to your myAudi account. The information on the charging process is overwritten each time a new record is sent, so that We only store the current status.

8.3 Special Information – remote control climate control

As part of the Service, We process the following data or categories of data from your vehicle: the vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner), current climate control status in the vehicle. We also process the climate control timers scheduled by you in myAudi, selection of the heating source as well as special configurations of the auxiliary climate control (e.g. heating of the glass surfaces) and seat heating.

We process the above data to provide the Service in order to communicate with your vehicle and to enable you to configure and control the climate control process via smartphone or via myAudi and to display the climate control status.

The climate control timers and settings you have configured are saved until you change them. The climate control information from your vehicle is overwritten when sending a new record, so that We only store the current status.

9. Special Information – third-party Services

If you make use of the opportunity to use online Services of other providers (third parties), these Services are subject to the responsibility and the privacy and terms of use of the respective provider. We generally have no influence on the content exchanged here.

Therefore, please obtain information on the nature, extent and purpose of the collection and use of personal data in the context of third-party Services by the respective service provider.

9.1 Data packages

This offer enables each user to purchase data packages for the use of the Wi-Fi hotspot from a partner mobile service provider of AUDI AG and to use them in the linked vehicle. Prerequisite is the registration of a SIM owner with the mobile service provider. AUDI AG will not transfer any personal data to the mobile service provider unless you have consented to such use or transfer. We have no control over the amount of data that the wireless service provider collects in connection with the purchase of the data package and your use of the offering. The collection, processing, transmission and use of personal data as well as the intended purpose are determined exclusively by the mobile service provider. 9.2 Online news

In order to use the Service, please log in in the vehicle by specifying your myAudi login (username (email address) and password). If you persistently save your myAudi login data in the vehicle, you may be automatically logged in when using the Service in the future depending on the vehicle, i.e. without a new login. Prerequisite for this is that there is an online connection (e.g. through your mobile phone, plug-in SIM or fixed SIM).

Please note that the personalised Service is also accessible to third parties, if you have not logged out of the system or let them use your mobile phone (and your myAudi PIN, if you have created one) or if they can also use the plug-in SIM card registered to you.

This online Service is a personalised Service, i.e. the prerequisite for the use of the Service is the registration and opening of a separate and individual myAudi account.

In your myAudi account, you can configure the Service and transfer certain data and content for the features of your Audi Connect Services (via your mobile phone connection or Internet connection) to your vehicle, as well as permit a transfer of specific vehicle data from the vehicle to us or to the service provider, as described below.

As part of the Service, We process the following data or categories of data from your vehicle: The time of access to the Service and the nature of your request submitted via the MMI, the vehicle identification number (with which your vehicle can be uniquely identified and assigned to a specific owner) and your myAudi user ID.

We process the above data for the provision of the Service in order to transmit the data stored under your myAudi account for the features of online news to your vehicle (e.g. RSS feeds that you have saved on myAudi). The time of access to the Service and the vehicle identification number are also stored for a short time for the purpose of error analysis.

Within the scope of Audi connect, AUDI AG only permits the use of the communication or information Service in the vehicle which you have already purchased separately for online news ("service provider"). Accordingly, We will forward your specified identification data (username and password) to the service provider for the request so that it can allow you to access the Service and make the Service available within the connect Services portfolio. The necessary identification and connection data are processed and used for the provision of Services and the proper functioning of the Services in accordance with the applicable legal requirements. Your identification data will be stored at AUDI AG for the use of the personalised information Service, so that you do not have to log in separately for each individual use process.

9.4 Audi Online Music

Audi Online Music allows you to use the Amazon Music service of Amazon EU S.à r.l. (Société à responsabilité limitée), 5 rue Plaetis, L-2338 Luxembourg, or the Napster music streaming service of Napster Luxembourg S.à r.l., 60, Route de Luxembourg, L-5408 Bous, Luxembourg in your MMI display. The prerequisite for this is generally that you are registered as a user of Amazon Music or Napster.

To the extent that you use Amazon Music through the app, the app will only forward the login and password you have entered for your Amazon Music member account to Amazon in order to verify your eligibility and allow access to the Service. For future logins, only your authorisation (so-called token) will be saved in the app. A storage of your login data does not take place in the app. These are not transmitted to our IT systems, either.

Through the access to the Napster app, the app allows a certain control of the Napster app via the MMI, for example, you can retrieve playlists and media titles for playback in the MMI of the Napster app. The Napster app transmits your login name to the app for your control.

9.5 Travel

With the travel Service, the time of access to the Service and the current location of your mobile device or the position that you have defined yourself (search position) is transmitted to the service provider (see below) with each user request – it is not transmitted here whether you have specified the location of your mobile device or the search positions. In addition, you can transmit further search parameters, such as selected search categories (e.g. "museums," "castles" etc.), a specific search term (by direct input of the user) or additional filter settings (e.g. "only museums" etc.).

In order to provide the Travel Service, the Service Provider uses the above data to inform you of any points of interest at the destination or any other search area you have defined. The Service allows access to commercial travel guide content of the service provider (see below) via the app. The contents can be queried both directly on the mobile device and in the vehicle, provided that there is a Wi-Fi connection between the mobile device and the vehicle. You can also mark individual travel destinations by storing them locally on the mobile device and subsequently retrieving them from this memory in the vehicle.

To the extent necessary for the provision of the Service, the data are transmitted directly from the app to the service provider iPUBLISH Ganske Interactive Publishing GmbH, Possmoorweg 2, D-22301 Hamburg www.ipublish.de, but it uses them exclusively for the provision of the Service and, if necessary, for system-side troubleshooting. No personal data is transmitted to the service provider.
